Terms of Service
Effective date: 24 August 2026
These Terms of Service (“Terms”) govern access to and use of TobSar's websites, mobile applications for iOS and Android, seller dashboard, APIs, bots, integrations, and related services (together, the “Services”). By creating a TobSar account, downloading or using the TobSar mobile app, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. About TobSar
TobSar provides an AI sales agent and social commerce management platform for businesses. TobSar helps businesses manage customer conversations, product catalogs, orders, leads, reports, analytics, and workflows across connected platforms such as Meta platforms including Facebook and Instagram, Telegram, TikTok, and other supported tools.
The Services are offered through:
- the TobSar website at https://tobsar.com;
- the TobSar seller dashboard;
- the TobSar mobile application for iOS and Android, distributed through the Apple App Store and Google Play; and
- TobSar APIs, bots, and integrations.
Unless a section says otherwise, these Terms apply equally to all of them.
2. Eligibility and Accounts
TobSar is a business tool intended for merchants, sellers, and their staff. You must be at least 18 years old and legally able to enter into these Terms. If you use TobSar on behalf of a company, you confirm that you have authority to bind that company to these Terms.
To use the Services you must create a TobSar account. Accounts are created and authenticated using Firebase Authentication with an email address and password, or with Google Sign-In. You must provide accurate registration information and keep it up to date.
TobSar is not directed at children and may not be used by anyone under 18.
3. The TobSar Mobile Application
3.1 License
Subject to these Terms, TobSar grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the TobSar mobile app on a device you own or control, solely for your own business purposes.
You may not copy, modify, reverse engineer, decompile, disassemble, rent, lease, resell, redistribute, or create derivative works of the app, or attempt to extract its source code, except to the extent this restriction is prohibited by applicable law.
3.2 Device permissions
The app asks for the following device permissions. Each is optional, is requested only at the moment the related feature is used, and can be withdrawn at any time in your device settings — the rest of the app continues to work without it.

TobSar does not access your contacts, calendar, SMS, call logs, precise or background location, or health data, and does not read your device's advertising identifier.
3.3 Connected channels
Core features of the app depend on you connecting your own business channel — a Facebook Page you manage, or a Telegram bot you own. Connecting a channel authorizes TobSar to receive messages sent to that channel and to send replies on your behalf, as described in the Privacy Policy. You may disconnect a channel at any time in the app, in the seller dashboard, or directly from the third-party platform.
3.4 Connectivity
The app requires an internet connection and an active TobSar account. There is no offline mode. Features, screens, and data are served from TobSar's backend and may change as the Services are updated.
3.5 Updates
TobSar may release updates, fixes, and new versions of the app through the Apple App Store and Google Play. Some updates may be required for the app to keep working with the Services. Your device settings control whether updates install automatically.
4. Account Responsibilities
You are responsible for:
- Keeping your login credentials secure
- Managing access for team members
- Ensuring your account information is accurate
- All activity that occurs under your account
- Ensuring you have permission to connect third-party accounts and business assets
You must notify TobSar if you believe your account has been accessed without authorization.
5. Third-Party Integrations
TobSar may allow you to connect third-party services, including Meta platforms such as Facebook and Instagram, Telegram, TikTok, e-commerce platforms, advertising platforms, CRM tools, and messaging services.
By connecting a third-party service, you authorize TobSar to access and process data from that service according to the permissions you grant and the settings you choose.
You are responsible for complying with all third-party platform terms, policies, advertising rules, commerce rules, privacy requirements, and applicable laws — including the Meta Platform Terms, the Meta Messenger Platform policies, and the Telegram Bot Terms. Messages sent through a connected channel are also subject to that platform's own messaging rules, including any window or opt-in requirements it imposes.
TobSar is not responsible for changes, downtime, restrictions, suspensions, API limits, or policy enforcement actions by third-party platforms.
6. Acceptable Use
You agree not to use TobSar to:
- Violate any law, regulation, or platform policy
- Send spam, scams, misleading messages, or unauthorized marketing
- Upload or distribute illegal, harmful, abusive, deceptive, or infringing content
- Misuse customer data, platform data, or advertising data
- Attempt to access systems or data without permission
- Interfere with TobSar security, infrastructure, or service operation
- Create fake engagement, fake accounts, or inauthentic activity
- Sell, rent, or misuse data obtained from third-party platforms
- Automate messaging in a way that breaches the rules of the platform the message is sent on
7. AI-Generated Content
TobSar provides AI-generated replies, suggestions, recommendations, summaries, and automation, drawn from the product catalog, prices, and knowledge base you supply.
You review replies before they are sent. The assistant drafts a reply and places it in a review queue in the app, where you approve, edit, or reject it. Nothing reaches your customer until you approve it.
TobSar may later offer the option to let the assistant send certain replies automatically on your behalf. Where you turn such an option on, replies are still sent under your business identity and you remain responsible for them, and the app's AI settings will show what the assistant is permitted to send without you.
AI output may be inaccurate, incomplete, or inappropriate. You are responsible for reviewing the assistant's configuration and its output, and for ensuring that AI-generated messages, product claims, prices, and customer communications comply with applicable laws and platform policies, including any obligation to tell customers that they may be talking to an automated assistant.
TobSar does not guarantee that AI-generated content will be accurate, complete, or appropriate for every situation.
8. Customer Data and Permissions
You are responsible for ensuring you have the necessary rights, permissions, consents, and legal basis to upload, process, or use customer data in TobSar. This includes customer messages, leads, phone numbers, email addresses, order data, audience data, and advertising data.
As between you and TobSar, the customer conversations, product information, and order records in your account are your business data. TobSar processes them on your behalf to provide the Services.
9. Fees and Payments
The TobSar mobile app is free to download, and there are currently no in-app purchases or subscriptions sold inside the app. Where TobSar offers paid plans, fees are agreed and billed outside the app, and the applicable prices, billing cycle, and cancellation terms are described on the TobSar website, in the dashboard, or in a separate agreement.
If TobSar ever offers a subscription or digital purchase inside the mobile app, that transaction will be processed by Apple or Google under their payment terms, and their billing, renewal, and refund rules will apply.
Failure to pay agreed fees may result in suspension or termination of access.
10. Intellectual Property
TobSar owns all rights in its software, technology, designs, systems, branding, and services.
You retain ownership of your business data, customer data, content, product information, and materials you upload to TobSar.
You grant TobSar permission to process your data only as needed to provide, secure, improve, and support the Services.
11. Service Availability
We aim to provide reliable service, but the Services may be unavailable due to maintenance, updates, outages, third-party platform issues, security events, or other reasons.
We do not guarantee uninterrupted or error-free service.
12. Suspension, Termination, and Account Deletion
You may stop using TobSar at any time.
You can request deletion of your account and its data at any time, and you can start the request from inside the app — open Settings → Data deletion, which opens our deletion instructions. You may also follow the instructions at https://tobsar.com/data-deletion, or email info@tobsar.com.
We may need to verify that you are the account owner before acting on a request. After verification we close your account and delete or de-identify your data as described in the Privacy Policy, normally within 30 days; some information may be retained where required for legal, security, fraud-prevention, accounting, or dispute-resolution purposes.
Deleting the app from your device does not by itself delete your account.
We may suspend or terminate access if you violate these Terms, misuse the Services, create risk, fail to pay fees, or violate platform policies or applicable laws. After termination, we may delete or retain data according to our Privacy Policy and legal obligations.
13. Disclaimers
TobSar is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability.
TobSar does not guarantee specific sales, revenue, advertising results, customer responses, approval by third-party platforms, or campaign performance.
14. Limitation of Liability
To the maximum extent permitted by law, TobSar will not be liable for indirect, incidental, special, consequential, punitive, or lost-profit damages.
TobSar is not responsible for losses caused by third-party platforms, user error, unauthorized access caused by weak credentials, platform policy violations, advertising account restrictions, or business decisions made using TobSar data or AI output.
15. Additional Terms for the Apple App Store
These terms apply to the TobSar app obtained from the Apple App Store and are required by Apple.
- Acknowledgement. These Terms are between you and TobSar only, not with Apple. TobSar, not Apple, is solely responsible for the app and its content.
- Scope of license. The license granted in section 3.1 is limited to a non-transferable license to use the app on any Apple-branded product that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- Maintenance and support. TobSar is solely responsible for providing maintenance and support for the app. Apple has no obligation to furnish any maintenance or support services.
- Warranty. TobSar is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you — the app is free, so no purchase price applies. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app.
- Product claims. TobSar, not Apple, is responsible for addressing any claims relating to the app, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
- Intellectual property claims. In the event of a third-party claim that the app or your use of it infringes that third party's intellectual property rights, TobSar, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim.
- Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-party terms. You must comply with any applicable third-party terms of agreement when using the app.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as a third-party beneficiary.
- Contact. Questions, complaints, and support requests about the app should be directed to info@tobsar.com.
16. Additional Terms for Google Play
The TobSar app obtained from Google Play is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the app. Support for the app is provided by TobSar at info@tobsar.com, not by Google.
17. Changes to These Terms
We may update these Terms from time to time. When changes are made, we will update the effective date above and, where the change is significant, notify you by email or in the app or dashboard. Continued use of TobSar after changes means you accept the updated Terms.
18. Governing Law
These Terms are governed by the laws of the Kingdom of Cambodia, where TobSar operates, unless another jurisdiction is required by applicable consumer or data protection law.
